1 Agreement & Acceptance

These Terms of Service ("Terms", "Agreement") represent a binding legal contract between you ("Client", "User", "you") and GrowCap Media ("GrowCap Media", "we", "our", "us"), having its principal place of business in Hosur, Tamil Nadu, India.

By utilizing our website, booking a strategy consultation, approving a service proposal, or paying an invoice for our marketing services, you represent that you are at least 18 years of age and hold the legal authority to bind yourself or your company to this Agreement.

2 Scope of Marketing Services

GrowCap Media offers performance digital marketing and development services across:

3 Client Responsibilities

To ensure timely campaign launch and peak performance, the Client agrees to:

• Provide required brand guidelines, logos, product catalogs, and account access permissions in a timely manner.
• Review and provide feedback or approvals on ad copies, creatives, and landing pages within 48 to 72 hours.
• Ensure all products, services, claims, and guarantees advertised comply with applicable Indian laws and advertising codes.

5 Third-Party Platforms & Disclaimers

Campaign execution takes place on external platforms (Google, Meta, LinkedIn) governed by independent algorithmic systems:

• We test and optimize using industry best practices; however, third-party platforms may update algorithms, auction dynamics, or policies at their discretion.
• GrowCap Media cannot guarantee specific gross revenue, absolute #1 Google rankings, or precise lead counts due to fluctuating competitor bids and market conditions.
• Client acknowledges that account suspensions or ad disapprovals caused by past domain infractions or sudden policy shifts are external platform determinations.

6 Intellectual Property & Deliverables

Upon receipt of all agreed fees, the Client holds full ownership of final ad creatives, approved copy, and customized web assets developed explicitly for the Client. GrowCap Media retains rights to proprietary automation frameworks, internal code libraries, and generic marketing methodologies.

7 Confidentiality & Limitation of Liability

Both parties agree to hold non-public business strategies, customer lists, and financial figures in strict confidence. To the extent permitted by law, GrowCap Media's aggregate financial liability for any claim shall not exceed the service fees actually paid by Client in the three (3) months preceding the claim.

8 Term & Cancellation Policy

Standard monthly retainers may be canceled by either party with thirty (30) days written notice. Upon settlement of final invoices, GrowCap Media will conduct a smooth handover of ad accounts and digital assets.
